Why is cheating not criminalized? It is a malicious act that is only possible through the gross negligence of someone who is supposed to be a trusted loved one, and intentional infliction of distress upon the victim. It is disruptive to society as it severely traumatizes innocent individuals, the emotional pain often mentally crippling the victim.

If someone were to physically attack another person to the point it left one of their limbs dysfunctional, that violence would surely be punished. But an assailant who mentally attacks another person, rendering part of their brain dysfunctional, walks away and is free to do it to more future partners again, and again, without any fear of consequence. Adult humans have been shown to process the trauma of being cheated on in almost identical ways to how children process being abandoned by a parent.

I personally think cheaters should be put on sex offender lists and should be prosecuted in a similar fashion as rapists. Cheating involves the violation of your partner’s sexual consent. While rape is certainly a far, far more traumatic experience to be a victim of, I believe cheaters should be looked at in a related vein as rapists. Cheaters moving into a new neighborhood should be required to inform all of their neighbors about their infidelity, and be made to tell their employers so that their co-workers can all be aware of who they’re dealing with.

Of course there need to be reasonable boundaries on this. It would likely only be actual sex that counts as prosecutable cheating. And this would likely be hard to actually prove to law enforcement, sadly similar to if you’ve been the victim of rape. However the existence of these laws I believe would serve as a massive deterrent to the huge amounts of undeterred infidelity we are all at risk of falling victim to.
